Terms and Conditions

These Terms and Conditions apply to all training services provided by ELECSURE ADVISORY PTY LTD (ABN 58 690 213 560) trading as ElecSure Academy (“ElecSure Academy”, “we”, “us”, or “our”).

By enrolling in, attending, or otherwise participating in any ElecSure Academy training, you agree to be bound by these Terms and Conditions.

1. Training Services

ElecSure Academy provides electrical safety training services through public courses, on‑site delivery, and other agreed formats.

All training is provided for educational and professional development purposes only. Course content may be updated, modified, or withdrawn at any time at ElecSure Academy’s discretion.

2. No Professional Advice or Warranty

All training content is general in nature and provided for educational purposes only.

ElecSure Academy does not warrant or represent that:

  • Training content is complete, exhaustive, or suitable for any specific site, asset, system, or task

  • Attendance at a course ensures compliance with legislation, standards, codes of practice, or organisational requirements

  • Training outcomes will eliminate electrical risk or result in safe systems of work

Participants remain solely responsible for:

  • Exercising their own professional judgement

  • Identifying hazards and implementing appropriate risk controls

  • Complying with applicable legislation, standards, procedures, and employer requirements

3. Fees and Payment

Course enrolments may be accepted as provisional until payment is received.

To confirm a participant’s attendance, full payment of course fees must be received in accordance with the following timeframes:

  • Where a provisional enrolment is made more than 20 business days prior to the course start date, full payment must be received within 10 business days of the enrolment; or

  • Where a provisional enrolment is made 20 business days or fewer prior to the course start date, full payment must be received immediately.

ElecSure Academy reserves the right to:

  • Cancel any provisional enrolment where payment has not been received within the required timeframe

  • Refuse attendance at a course where payment has not been received in full prior to commencement

Invoices must be paid in accordance with the payment terms stated on the invoice unless otherwise agreed in writing.

4. Course Scheduling and Changes

ElecSure Academy may reschedule, postpone, or cancel a course due to low enrolments, facilitator availability, venue issues, or circumstances beyond our reasonable control.

Where ElecSure Academy cancels a course, participants will be offered:

  • Transfer to a rescheduled or alternative course date, or

  • A refund of course fees paid

ElecSure Academy is not responsible for any travel, accommodation, or other costs incurred by participants.

5. Participant Responsibilities

Participants must:

  • Ensure they meet any stated course prerequisites

  • Act in a safe, professional, and respectful manner

  • Comply with venue, site, and facilitator safety instructions

  • Disclose any condition that may affect safe participation in training

ElecSure Academy reserves the right to remove any participant whose behaviour is unsafe, disruptive, or inappropriate. No refund will be issued in such circumstances.

6. Cancellations and Refunds

Participant Cancellations

  • Cancellation requests must be made in writing

  • Cancellations received more than 10 business days prior to the course start date are eligible for a full refund or transfer

  • Cancellations received within 10 business days of the course start date are not eligible for a refund

  • For cancellations within 10 business days, participants may reschedule to a future course date (subject to availability) upon payment of a rescheduling fee equal to 25% of the original course fee

  • Non‑attendance without prior notice will result in forfeiture of all fees

Participant substitutions may be accepted with prior notice, subject to course requirements and approval.

7. Certification and Recognition

ElecSure Academy is not a Registered Training Organisation (RTO).

Completion of a course does not result in the issuance of a Statement of Attainment or any nationally recognised qualification under the Australian Qualifications Framework (AQF).

Upon successful completion, ElecSure Academy will issue a Certificate of Attendance, recording:

  • Course title

  • Date(s) attended

  • Total contact hours completed

Certificates of Attendance are intended to support professional development records, internal competency frameworks, and audit evidence, where applicable.

8. Intellectual Property

All training materials, content, and intellectual property remain the property of ElecSure Academy unless otherwise stated.

Participants must not reproduce, distribute, modify, or provide training materials to any third party without prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law:

  • ElecSure Academy excludes all warranties, representations, and guarantees, whether express or implied

  • ElecSure Academy is not liable for any loss, damage, cost, or expense arising from participation in training or reliance on training materials

  • ElecSure Academy is not liable for indirect, consequential, or economic loss, including loss of profit, business interruption, or reputational damage

Nothing in these Terms and Conditions excludes, restricts, or modifies rights under the Australian Consumer Law that cannot be excluded.

10. Indemnity

By enrolling in or attending any ElecSure Academy course, you agree to indemnify, hold harmless, and defend ELECSURE ADVISORY PTY LTD (ABN 58 690 213 560) trading as ElecSure Academy, including its directors, officers, employees, contractors, and agents, from and against any and all claims, damages, losses, liabilities, judgments, awards, settlements, costs, and expenses (including legal costs, attorney’s fees, and court costs) arising out of or resulting from:

  • Your use of or reliance on any training materials or course content

  • Any act or omission by you following attendance at a course

  • Any breach of these Terms and Conditions

This indemnity survives course completion or withdrawal.

11. Assumption of Risk

You acknowledge that:

  • Electrical work and environments present inherent hazards

  • Training does not replace site‑specific risk assessments or controls

  • You remain responsible for your own safety and compliance obligations

12. Acceptance of Terms

Attendance at an ElecSure Academy course constitutes full acceptance of these Terms and Conditions.

These Terms and Conditions represent the entire agreement between you and ElecSure Academy in relation to training services. No other terms or conditions apply unless expressly agreed in writing by ElecSure Academy.

13. Privacy

Personal information is collected and handled in accordance with applicable privacy legislation and is used for course administration, certification, and related communication.

14. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia, and the courts of Queensland have exclusive jurisdiction.
